Acceptance of Terms

1.1 These terms and conditions ("Terms") are the terms on which we make available www.hiac.org.uk (the "Website") and the Service to you.  You should keep a copy of these Terms for future reference.  These Terms are only available in the English language.

1.2 You must read these Terms carefully.

Changes to Terms

1.3 We may change these Terms for legal, regulatory or security reasons or to reflect any changes to the Service.  We will use reasonable efforts to inform you of any significant changes to the Terms, which may be by way of us posting changes to the Terms on the Website, so you should check the Terms each time you visit the Website.  You may end this Agreement by giving us notice by email if we tell you we are going to change these Terms to your detriment.

Your promises to us

3.1 You confirm that:

   3.1.1 you are over 18;

   3.1.2 all information and details provided by you to us are true, accurate and up to date in all respects and at all times.  You can update or correct your details at any time by emailing authentication@hiac.org.uk;

   3.1.3 you will comply with the restrictions on your use of the       Website and the Service as set out in these Terms; and

   3.1.4 In relation to any material uploaded, submitted to or posted on the Website by you that you have the right to do so and have obtained all necessary licences, consents and or approvals.

Your conduct

3.2 You agree that in using the Service and the Website you will not:

   3.2.1 use the Service or the Website for any unlawful purpose;

   3.2.2 use the Website in any way that interrupts, damages, impairs or renders the Website less efficient;

   3.2.3 transfer files that contain viruses, trojans or other harmful programs;

   3.2.4 penetrate or attempt to penetrate the Website security measures;

   3.2.5 email or otherwise disseminate any content which is defamatory, obscene, or may have the effect of being harassing, threatening or abusive to an individual or group of individuals whether on the basis of religion, gender, sexual orientation, race, ethnicity, age or disability or otherwise

   3.2.6 Your use of the Website or the Service and its contents grants no rights to you in relation to our intellectual property rights including, without limitation, copyright trade marks, logos, graphics, photographs, animations, videos and text or the intellectual property of third parties in the Website, the Service and its contents.

   3.2.7 You may not copy, reproduce, republish, download, post, broadcast, record, transmit, commercially exploit, edit, communicate to the public or distribute in any way the services, web pages or materials on the Website or the computer codes of elements comprising the Website other than for your own personal use. Subject to the above, you may download insubstantial excerpts of this content to your hard disk for the purpose of viewing it provided that no more than one copy of any information is made.

   3.2.8 Any use other than that permitted under this section may only be undertaken with our prior express authorisation.

   3.2.9 By submitting information, text, photos, graphics or other content to us via the Website, you grant us a right to use such materials at our own discretion in any media including, without limitation, to edit, copy, reproduce and disclose such materials.

   3.2.10 You may not establish links to this Website without Our prior written permission.

   3.2.11 We may provide links to other Websites from time to time (via advertising or otherwise).  You acknowledge that:

     - these links are provided for your ease of reference and convenience only;

     - we do not control such third party Websites and are not responsible for their contents;

     - our inclusion of links does not imply any endorsement of the material contained in such Websites or any association with their operators;

     - we will not be party to any transaction or contract with a third party that you may enter into via such sites;

     - we shall not be liable to you in respect of any loss or damage which you may suffer by using those websites; and

     - you agree that you will not involve us in any dispute between you and the third party.


4.1 We may wish to transfer our rights or obligations or sub-contract our obligations under these Terms to another other legal entity. You agree that we may do so provided that:

     -this will not adversely affect the standard of Service you receive under these Terms; and

     -in the case of transfer only, after we notify you of the date on which we will transfer our rights and obligations under these Terms to another legal entity, your only rights under or in connection with these Terms will be against the new legal entity and not against us.

4.2 These Terms are personal to you. You may not transfer your rights or obligations under these Terms to anyone else.

4.3 If you breach these Terms and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms.

4.4 If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other provisions shall continue to apply.

4.5 Except in the case of any breach by you of section Error! Reference source not found., which may be enforced by Damien Hirst and/or Science Ltd these Terms are not intended to give rights to anyone except you and us. 

4.6 We will do our best to resolve any disputes over these Terms.  If you wish to take court proceedings against us you must do so within the United Kingdom. If you live in England or Wales the laws of England and Wales shall apply and if you live in Scotland, Scottish law shall apply. 


How we collect your personal information

5.1 We may collect your personal information when:

   5.1.1 you submit information to us via the Website or via any other means;

   5.1.2 you make a complaint or enquiry or provide other feedback to us; or

   5.1.3 you contact us.

5.2 If you provide another person's personal information to us, you must first ensure you have his or her permission to do so.

How we use your data

5.3 We use your personal information to:

   5.3.1 process and complete your requests for the Service;

   5.3.2 process and deal with any complaints or enquiries made by you;

5.5 The information that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area ("EEA"). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this section 5.

How do we protect your Information?

5.6 Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to Our Website; any transmission is at your own risk. Once we have received your information, we will use procedures and security features to try to prevent unauthorised access.
